Terms of Service
These terms are an agreement between you and [Company legal name] ("PickLabz", "we", "us") for use of picklabz.com, the Lab Report and any related emails or alerts (the "Service"). By creating an account, starting a free trial or paying for a plan, you agree to these terms. If you do not agree, do not use the Service.
1. What PickLabz is, and is not
- PickLabz sells information. The Service provides sports picks, analysis and related data produced by our statistical model, for information and entertainment.
- PickLabz is not a sportsbook. We do not accept, place, hold or settle wagers of any kind, and we have no relationship with any sportsbook that pays us based on your bets.
- No contests, no prizes. We do not run contests, sweepstakes or fantasy games, and your subscription is never an entry fee for any prize.
- Your bets are your decisions. Any wager you place is made by you, with a sportsbook you choose, at your own risk.
2. Eligibility
- You must be 21 or older to create an account or subscribe.
- You are responsible for making sure sports betting, and using a service like this, is legal where you live and where you place any bet. Do not use the Service where it is prohibited.
- We may ask you to confirm your age, and we may refuse or close any account we believe belongs to someone under 21.
3. Your account
- One account per person. Keep your login private; you are responsible for activity on your account.
- Give us accurate information, including a working email address.
4. Plans, billing and free trial
- Plans. Weekly (7 days), Monthly (30 days) and 3 Months (90 days), at the prices shown at checkout. Every plan includes every pick.
- Free trial. New members get 2 days free. A payment method is required to start the trial. Unless you cancel before the trial ends, your first payment is charged when the trial ends.
- Automatic renewal. Plans renew automatically at the end of each period, at the then-current price, until you cancel. We will tell you before any price change takes effect.
- Payments are processed by our payment provider. We do not store your full card number.
- Cancellation and refunds are covered in the Refunds and Cancellation Policy, which is part of these terms.
5. Personal use only
Your subscription is for your own use. You may not copy, share, resell, republish, post or redistribute picks, the Lab Report, alerts or any part of the Service, including in group chats, social media, Discord servers or other paid services, without our written permission. We may close accounts that share picks, without a refund.
6. No guarantees
Sports outcomes are uncertain. Picks can and do lose. We do not guarantee any result, win rate or profit, and past results, including backtested results, do not predict future results. See the Disclaimer. Nothing in the Service is financial, investment, legal or tax advice.
7. Our content
The Service, the model, its picks, text, design and data belong to PickLabz or our licensors and are protected by law. We give you a limited, personal, non-transferable license to view them while your plan is active.
8. Acceptable use
Do not misuse the Service: no scraping or automated downloading, no attempts to access other accounts or our systems, no reverse engineering, and nothing unlawful.
9. Changes to the Service
We may add, change or stop sports, bet types, features or the schedule of picks. The model posts picks only when it finds an edge, so some days and weeks will have few or no picks; that is not a fault in the Service.
10. Ending your account
You can cancel any time. We may suspend or close accounts that break these terms, are used by someone under 21, or are involved in fraud or chargeback abuse.
11. Limitation of liability
To the fullest extent the law allows, PickLabz is not liable for any betting losses or for indirect, incidental, special or consequential damages arising from the Service. Our total liability for any claim is limited to the amount you paid us in the 3 months before the claim. The Service is provided "as is" and "as available", without warranties of any kind, to the extent the law allows.
12. Indemnity
You agree to cover PickLabz's costs and losses from claims arising out of your misuse of the Service or your breach of these terms.
13. Disputes and governing law
These terms are governed by the laws of the State of [State], without regard to conflict-of-law rules. Before filing any claim, please contact us at support@picklabz.com so we can try to resolve it informally.
14. Changes to these terms
We may update these terms. If a change is material, we will notify members by email or on the site before it takes effect. Continuing to use the Service after that means you accept the updated terms.
